# Terms of Service

These Terms of Service ("Terms") apply to https://hearthluma.shop, its shopping functions, and orders placed with hearthluma (collectively, the "Services"). SUJEEWA SENARATH LLC owns and operates hearthluma and is referred to as "we," "us," or "our." By accessing the Services or placing an order, you accept these Terms and the Store policies they incorporate.

## 1. Eligibility and Accounts

You must be legally capable of entering a binding contract in your jurisdiction. A person below the applicable age of majority may use the Services only with parent or legal guardian permission and supervision.

Provide complete and current account, payment, and delivery information. If customer accounts are available, keep credentials secure and notify us promptly of suspected unauthorized access. You are not responsible for activity resulting from our failure to maintain reasonable security.

## 2. Store Conduct

Use the Services only for lawful personal shopping and other purposes we expressly allow. You must not:

- submit fraudulent information, impersonate another person, or use a payment method without authority;
- violate applicable law or another person's intellectual property, privacy, or legal rights;
- upload harmful code, interfere with operation, bypass controls, or probe security without permission;
- scrape or collect Store information through unauthorized automated methods;
- transmit unlawful, abusive, threatening, or deceptive material; or
- reproduce, resell, or commercially exploit Store content without written permission.

We may restrict activity reasonably believed to involve fraud, illegality, serious abuse, or a security threat. Mandatory customer rights remain unaffected.

## 3. Products and Availability

We make reasonable efforts to keep product photographs, colors, measurements, specifications, descriptions, prices, and stock information accurate. Screen settings may affect appearance, and ordinary manufacturing variation can occur. Remedies remain available for products that are faulty, materially misdescribed, or unfit for a purpose protected by law.

Availability may change before acceptance. Cart placement is not a reservation. We may apply reasonable quantity limits by customer, account, household, address, payment method, or order to allocate inventory and prevent fraud or unauthorized resale.

## 4. Pricing, Tax, Shipping Charges, and Payment

Checkout shows the currency, product price, delivery charge, and total before payment. Later price changes do not affect an accepted order. Section 12 addresses obvious errors.

For a delivery address accepted at checkout, the total is intended to include applicable taxes and import duties. hearthluma does not require a separate tax, customs-duty, or import-fee payment on delivery. Standard shipping is free when the discounted order subtotal is more than US$30. If the subtotal is US$30 or less, the shipping charge is displayed at checkout. Optional premium delivery is separately identified and priced.

You confirm authorization to use the chosen payment method and permit us and the provider to process the transaction. The provider's separate terms may apply.

## 5. Acceptance of Orders

An automated email acknowledges that the order reached our system but does not necessarily mean we accepted it. A contract forms when we send a dispatch confirmation or otherwise clearly communicate acceptance.

Before acceptance, we may reject or cancel for a genuine reason, including unavailable inventory, failed payment verification, suspected fraud, an unsupported destination, a legal restriction, or an obvious listing error. Any captured payment will be refunded to the original method.

Review the merchandise and address before checkout. Email nabsocashigne@outlook.com immediately to request a correction. We will try to apply it but cannot guarantee a change after fulfillment starts.

## 6. Fulfillment and Delivery

The Shipping Policy is part of these Terms. Normal processing takes 2-3 business days. Standard transit after dispatch is then estimated at 20-45 calendar days. Customs, weather, carrier capacity, holidays, remote locations, and circumstances outside reasonable control can affect delivery.

Except where mandatory law provides otherwise, risk in a consumer order transfers when the parcel is delivered to the customer or a person designated by the customer. Ownership passes after full payment and delivery.

## 7. Returns, Cancellations, and Refunds

Our Return and Refund Policy is incorporated into these Terms. Eligible merchandise may be returned free when the request is submitted within 30 days after delivery. Following issuance of an approved refund to the original payment method, funds normally post within 3-7 business days, depending on the financial institution.

The separate policy explains product condition, exclusions, prepaid labels, exchanges, and remedies for incorrect or defective goods. Nothing in these Terms limits a cancellation, conformity, or refund right that cannot legally be excluded.

## 8. Promotions

An offer can include separate conditions displayed with it. Unless otherwise stated, a promotional code has no cash value, cannot be combined, and expires as disclosed. We may correct an offer issued or applied by mistake but will not unfairly change it after accepting the associated order.

## 9. Customer Submissions

You retain ownership of a review, photograph, feedback, or other submission. You grant SUJEEWA SENARATH LLC a non-exclusive, worldwide, royalty-free license to store, format, reproduce, publish, display, and use it for operating and promoting hearthluma. The license ends when content is removed from active systems, except for lawful backups and previously distributed material that cannot reasonably be recalled.

You confirm that you have the right to provide the content and that it is lawful, accurate, non-infringing, and does not expose private information or abuse another person. We may moderate or remove content that fails these standards.

## 10. Intellectual Property Rights

Original Store copy, layout, graphics, photographs, logos, branding, and software are owned by or licensed to SUJEEWA SENARATH LLC and protected by law. Visitors receive a limited, personal, revocable, and non-transferable permission to access them for shopping. No ownership right transfers.

Product names, third-party marks, and external materials remain the property of their respective owners. Their appearance does not imply endorsement unless expressly stated.

## 11. Shopify, Providers, and Links

Shopify supplies our commerce platform. Other organizations may support payment, applications, analytics, fulfillment, and delivery. Their separate terms and privacy notices may govern direct interaction. We do not control independent websites linked from the Store, although this does not exclude responsibility legally assigned to us for providers acting on our behalf.

## 12. Errors and Corrections

Store information may occasionally contain a typographical error, omission, incorrect price, inaccurate description, or outdated availability. We may correct and update information. If a material correction affects an order already submitted, we will explain it and allow acceptance of the corrected terms or cancellation for a full refund. A trivial error will not be used to avoid an otherwise valid accepted order.

## 13. Privacy

The Privacy Policy is incorporated here. It describes our collection, use, disclosure, retention, cookies, choices, and privacy-rights procedures.

## 14. Warranties and Availability

To the extent permitted by law, website access is offered on an "as available" basis without guaranteeing uninterrupted or error-free operation. Products remain subject to their descriptions, express warranties, and every implied warranty or consumer guarantee required by applicable law.

Nothing here waives a protection or remedy that cannot legally be waived. Limitations apply only where enforceable.

## 15. Limits of Liability

To the fullest lawful extent, neither party is liable to the other for indirect, incidental, special, or consequential loss that was not reasonably foreseeable when the contract formed. For a contractual product claim, our aggregate liability will otherwise not exceed the amount paid for the affected product unless a greater remedy is legally required.

We do not limit liability for fraud, fraudulent misrepresentation, intentional misconduct, death or personal injury caused by negligence, breach of mandatory consumer rights, or another liability that cannot lawfully be limited.

## 16. Loss Caused by Improper Conduct

Where permitted, a user must reimburse reasonable direct loss caused by unlawful use, a material breach of these Terms, or infringement of another person's rights. This does not cover loss caused by us and does not reduce consumer protections.

## 17. Suspension and Termination

You may stop using the Services at any time. We may restrict access when reasonably necessary because of a serious breach, fraud, a security risk, or a legal requirement. Provisions intended to continue, including payment, ownership, liability, and dispute clauses, remain effective.

## 18. Governing Law and Disputes

Wyoming law and applicable U.S. federal law govern these Terms, without applying conflict-of-law rules. A consumer retains mandatory protections available under the law of the consumer's usual residence.

Before formal proceedings, email nabsocashigne@outlook.com with the order number and a clear explanation of the concern. We will attempt a good-faith informal resolution. Either party may still use a court, regulator, or consumer process available under applicable law.

## 19. General Provisions

These Terms and incorporated policies form the agreement concerning the Services and purchases. If a provision is unenforceable, it will be limited or removed only as necessary, leaving the remainder effective. Delay in enforcement is not a waiver. You may not transfer this agreement without our consent. We may transfer it in a legitimate financing, restructuring, or sale if customer rights are preserved.

## 20. Revisions

We may update these Terms for operational, service, or legal changes. Revisions apply prospectively after publication unless the law requires otherwise. The version effective when an order is accepted continues to govern that purchase.
